1. Booking
Your contract will be with Morningkerala Holidays. A contract will come into existence between you and Morningkerala Holidays, when we have confirmed you on our tour / hotel booking / or any other travel related services of your choice and we have received your booking request and deposits. All correspondence/s regarding the Tours / Travel Service bookings should be addressed to M/s Morningkerala Holidays.We confirms that you and other people on the tour accept our booking terms and condition and are entering into the contract
.

Payments: For the services contracted, at least 25% advance payment must be made to hold the booking on a confirmed basis and the balance amount can be paid before commencement of the tour. We hold the right to decide on the amount to be paid in advance, based on the nature of the services and the time left for the commencement of the services. Apart from the aforesaid conditions, in some cases including special train journeys like Palace on Wheels and hotel or resort bookings during the peak tourist season (X-Mas, New Year), full payment must be made in advance.

2. Payment Options:
All payments can be made to Morningkerala holidays, by cash, cheque, Demand Draft, Electronic money transfer. For booking which are made within 10 working days of tour departure, the full amount will become immediately payable. All payments are required to be free and clear of any withholding tax and deduction. Bank charges, if any, for remittance (by remitting bank or by intermediary bank) must be strictly borne by the payer.

3. Rights to amend the itinerary if required:
Tour once commenced will strictly adhere to the finalized itinerary. In case of unforeseen events and circumstances well beyond our control, we reserve the right to change all or parts of the itinerary for the safety and wellbeing of our esteemed passengers.

4. Policy Regarding Cancellation / No Show / Early Departure:
In case of cancellation of tour/travel services due to any avoidable/unavoidable reason/s whatsoever, we must be intimated in writing. Cancellation charges will be effective from the date of receipt of your letter. The cancellation charges are appended herewith:

* 60 days & prior to arrival - 10% of the tour/service cost
* 59 days to 30 days prior to arrival - 20% of the tour/service cost
* 29 days to 15 days prior to arrival - 25% of the tour/service cost
* 14 days to 08 days prior to arrival - 50% of the tour/service cost
* 07 days & less, prior to arrival or no show - NO REFUND

Please note - Irrespective of the aforesaid cancellations slabs, in case of cancellation of tour services after making the booking - a minimum 10% service charge would also be applicable.

In case you cancel the trip after commencement of the tour, refund would be restricted to a limited amount depending on the amount we would be able to recover from the hoteliers we patronize. For the unused hotel accommodation, chartered transportations and missed meals, etc., we do not bear any responsibility and liability for refund.We requires minimum 3 working days for starting process for executing tour programme for reservation orcancellation.Tourist can break journey at any place but on their own risk, Morningkerala Holidays is not bound to provide any arrangements for their accomodation, onward journey etc. in tour programme.

If You Change Your Booking
If, after our confirmation invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking. All cost incurred due to amendment will be borne by yourself

If We Change or Cancel Your Holiday
It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. CHANGE We will advise you of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements by assigning reasons to you. If we are unable to provide the booked travel arrangements, our liability in all cases shall be limited to the costs of your travel arrangements.

5. Refund:
With regards to the refund of unused / unutilized services (which are paid for and cancelled in advance) the refund amount would be worked out on the basis of the cancellation policy as mentioned above and the money would be accordingly refunded to the person who has made the payment to us. Please note that the refund process may take approximately 2 - 4 weeks to complete, due to banking procedures involved. If the refund is made to the credit card account OR to the Bank account, the bank charges would be deducted from the refund amount.

6. Our Liabilities & Limitations:
A. Please note that after the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges by the Govt. of India, the same would be charged as an additional amount from the customer.

B. Morningkerala Holidays acts only in the capacity of an agent for the hotels, airlines, transporters, railways & contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us are issued subject to the terms & conditions under which these services are provided by them.We are only your tour operator and at no time do we act as managers for your respective responsibilities and personal obligations. We are therefore not responsible for your acts, misdemeanor, omissions and neither are we responsible for managing any of your personal affairs; for example, we are not responsible for ensuring the safety of your personal belongings, travel documents, etc. at any time before the commencement of the tour or after it or during the tour.

C. All itineraries in the site are sample itineraries, intended to give you a general idea of the likely trip schedule. Several factors including the weather, road conditions, the physical ability of the participants, etc., may dictate itinerary changes either before the tour commencement or while on the trail. We reserve the right to change, without notice, any schedule in the interest of the trip participants' safety, comfort & general well being.We cannot and do not guarantee the exactness of any service that may be provided to you. For instance, photographs of the interiors of the hotel rooms posted on our website have been sourced from the respective Hotel management the visual appeal of a room selected by you cannot and is not guaranteed by us. Similarly, while we assure you of enjoyable holidays, we cannot and do not guarantee or represent that such tour will be as per your mental perception, imagination or thought about such tours.

D. Our rates are calculated on the basis of the prevailing rates as negotiated by us with the hotels, airlines, etc. Hotels and Airlines retain the right to modify the rates without any prior notice. In case of such changes, the rates quoted before the modification can be changed by us keeping in line with the modifications done by hotels or airlines. All hotel bookings are based on the usual check-in and check-out time of the hotels until unless indicated in the itinerary.

E. We shall not be responsible for any delays & alterations in the programme or expenses incurred - directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipments, breakdown of transport, weather, sickness, landslides, political closures or any other untoward incidents.

F. We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting - directly or indirectly - from any act of GOD, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferages, epidemics, medical or custom department regulations, defaults, or any other causes well beyond our control.We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: - the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable.

G. We do not have any insurance policy to cover the expenses for accident, sickness, loss due to theft, or any other reasons. Travelers from abroad are advised to seek such insurance arrangements in their home country. All luggage & personal property/s are at the client's risk at all times.

H. Behaviour and damage
When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be made direct to the accommodation owner or manager or other supplier or to us as soon as possible. If the actual cost of the loss or damage exceeds the amount paid where estimated, you must pay the difference once known. If the actual cost is less than the amount paid, the difference will be refunded. You will also be responsible for meeting any claims subsequently made against us and all costs incurred by us (including our own and the other party’s full legal costs) as a result of your actions. You should ensure you have appropriate travel insurance to protect you if this situation arises. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

6. Passports & Visas
To travel to India from overseas countries, except for the citizen of Nepal & Bhutan, one needs a 6 month valid passport and a valid Visa. Kindly note that the processing fee involved for Passport and Visa are not included in the tour cost.

7. Health
Any person who has a contagious disease is forbidden to travel; any person found during the tour with such a disease will be asked to leave the tour and will have to make their own arrangements to return home.

8. Arrival and Departure Policy:

* Check-in - 1200 – 1500 Hours
* Check-out – 1000 - 1200 Hours

Early arrival is subject to availability. For a guaranteed early check-in, reservation needs to be made starting from the night before. Late check-outs are available on request, but is subject to availability / payment. We can always make a request for an early check-in or a late checkout if required, but we do not guarantee it, which is entirely dependent on the hotel policies, time of the year and the availability of the room.

Our services are based on the information provided by the hotels; for this reason, the hotels remain responsible for the correctness of this information. Hotels can alter the information about their hotel, such as prices and availability, at any moment. The service is provided on an "as is" and "as available" basis. If You Have a Complaint If you have a problem during your holiday, PLEASE INFORM THE RELEVANT SUPPLIER (e.g. your hotelier) and/or our representative IMMEDIATELY who will endeavour to put things right. If your complaint is not resolved locally, please follow this up within 7 days of your return home by writing to us, giving your booking reference and all other relevant information. However, please be advised that while we are happy to assist you in your redressal of your complaint, if any, we will be able to extend only our best efforts in managing/coordinating your complaint with the respective service provider. All third party service providers are independent contractors who at no time are under our control or supervision.

Any material obtained through the use of the service is done at your own discretion and risk and you will be solely responsible for any damage that may result with the use of any such material or service. 10. Insurance
We consider adequate and appropriate travel insurance to be essential. It is your responsibility to purchase an appropriate travel insurance policy which provides sufficient cover to meet your personal requirements in respect of at least cancellation, curtailment, medical expenses (including repatriation by air if necessary), death and personal injury, loss or damage of personal possessions. You must also ensure that your insurance will cover you in respect of the activities you intend to undertake, particularly those of a hazardous or unusual nature.

11. Child Poicy
- Child below 5 years will be accommodated on Complimentary basis without extra bed.
- Child from 5-12 years will be accommodated with one extra bed, subject to a maximum of 2children as per extra person rate, for each child.
- Child above 12 years will be accommodated with one extra bed, subject to a maximum of one person, as per extra person rate..

12. Passanger Complaints / Comments
In the unlikely event that you have any reason to complain or experience any problems with your holiday whilst away, you must immediately inform the supplier of the service(s) in question. Any verbal notification must be put in writing and given to the supplier as soon as possible. If any complaint or problem is a serious one which is not resolved to your satisfaction by the supplier, you must contact us. Until we know about a complaint or problem, we cannot begin to resolve it. Most problems can be dealt with quickly. If you remain dissatisfied, however, you must write to our Customer Services Department at Morningkerala Holidays , S M J Building, North Paravur,Ernakulam Dist.( Kochi), Kerala, India. However, please be advised that while we are happy to assist you in your redressal of your complaint, if any, we will be able to extend only our best efforts in managing/coordinating your complaint with the respective service provider. All third party service providers are independent contractors who at no time are under our control or supervision. Governing Law This agreement and each TOS shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the court at North Paravoor, kerala.
